1. Application and interpretation
1.1 Parties and purpose
These Terms and Conditions set out the rules governing purchases made through this online store and the resulting rights and duties of the store operator (the Seller) and the person placing an order (the Buyer). They apply to contracts entered into remotely through the store and form part of each such purchase contract.
References to the Online Store mean the Pyrotime online store at https://pyrotime.eu, through which the Seller offers products and accepts orders. Products available through that website are referred to in this document as Goods.
1.2 Types of Buyer
The Buyer may be either:
- a consumer, meaning an individual purchasing outside the course of their business or independent professional activity; or- a business customer, meaning an individual or legal entity purchasing in connection with business activities.
Where a provision concerns consumers specifically, it applies only to Buyers acting in that capacity.
1.3 Applicable framework
Contracts and the relationships arising from them are subject to Czech law, particularly Act No. 89/2012 Coll., the Civil Code, Act No. 634/1992 Coll., on Consumer Protection, and other relevant legislation. Any departure from statutory rules must not be interpreted to the disadvantage of a consumer.
The Seller conducts business under the applicable trade authorisations. Its activities, including the sale and handling of pyrotechnic products, are carried out within the framework of the relevant Czech regulations.
1.4 Product range
The range consists primarily of pyrotechnic products in categories F1, F2, F3, P1 and T1, together with related merchandise offered in accordance with Czech legislation.
1.5 Contract language and communication costs
The contract is entered into in Czech. Contract documents and communications between the parties are also in Czech unless another language is agreed.
The Buyer pays their own costs of communicating remotely, including internet access and telephone calls. These are charged at the Buyer's ordinary basic rates.
1.6 Changes to these Terms
The Seller may reasonably revise or expand these Terms. Unless a later effective date is specified, a revised version takes effect when published in the Online Store. A revision does not alter rights or obligations established under an earlier version.
2. Eligibility to purchase and cross-border orders
2.1 Minimum ages
Some Goods may be purchased only by persons who meet the age requirement for the relevant category:
| Product category | Minimum age |
|---|---|
| F1 | 15 years |
| F2, P1 and T1 | 18 years |
| F3 | 21 years |
| Goods with no age restriction | No minimum age |
By placing an order, the Buyer declares that they meet the age requirement applicable to every restricted product included in it.
2.2 Checking eligibility
The Seller may check the Buyer's age before accepting the order, before dispatch or when the Goods are handed over. Verification may involve inspection of a valid identity document, a carrier's age-verification service or another method permitted by law. Only personal data necessary to establish compliance with the applicable requirements are processed for this purpose.
An identity document may also be requested during personal collection or delivery. If the Buyer does not provide adequate proof of age, fails to meet the relevant requirement or leaves justified doubts about their eligibility, the Seller may decline to enter into the contract, withdraw from a contract already concluded or withhold the Goods. A carrier performing the age check may likewise refuse handover.
Refusal to hand over Goods on these grounds does not constitute defective performance by the Seller. The Buyer may be required to reimburse actual delivery expenses, reasonably incurred costs or actual loss arising in connection with the failure to meet the purchase requirements.
2.3 Deliveries outside the Czech Republic
Before placing an order for delivery to another country, the Buyer must establish whether that country's rules allow the acquisition, possession, carriage and use of the selected Goods.
The Buyer is responsible for compliance with any import, export, customs, tax or other obligations connected with the transaction. The Seller does not accept responsibility for the Buyer's breach of another country's legislation.
Orders may be declined where shipment to the destination would conflict with legal requirements or safety rules.
3. Shopping and formation of the contract
3.1 Product listings
Product displays and descriptions provide information about the available range. They do not themselves constitute an offer under Section 1732(2) of the Civil Code, and displaying a product does not oblige the Seller to sell it. The Buyer's properly completed and submitted order constitutes the proposal to enter into a purchase contract.
3.2 Information shown before ordering
Displayed prices include applicable VAT and statutory charges where relevant. An advertised price may apply only for a specified period or while it remains displayed. The price becomes binding when the contract is concluded.
Packing and delivery charges contribute to the overall amount payable unless the parties agree otherwise. The ordering interface provides information about these charges.
3.3 Preparing and submitting an order
To place an order, the Buyer selects the Goods and quantities, chooses from the available payment and delivery methods and reviews the packing and delivery costs. Before submission, the Buyer may check and amend the information entered, including quantities, prices, payment choices and delivery details.
The Buyer makes the order binding by selecting the acceptance checkbox for these Terms and completing the order submission. Submission also confirms that the Buyer satisfies the legal conditions for the purchase, including any minimum age.
3.4 Acknowledgement and acceptance
An email acknowledging receipt of the order is sent to the address supplied by the Buyer. That acknowledgement alone does not create the contract.
The purchase contract comes into existence when the Seller expressly accepts the order, for example by issuing an invoice or confirming that the Goods have been dispatched.
3.5 Further verification and amendments
Depending on the order's characteristics, including its size, value or shipping costs, the Seller may request additional confirmation. Any proposed change becomes effective only after the Buyer accepts it by email or another reliable communication method.
The Seller may decline an order where the Buyer has repeatedly or seriously breached earlier purchase contracts or these Terms. Such a refusal must have proper grounds and be proportionate.
The Buyer agrees that the contract may be negotiated and concluded through remote communication, including email and the Online Store interface.
4. Prices, payments and invoices
4.1 Available payment options
Subject to the options displayed in the Online Store, payment may be made:
- in cash at the Seller's premises or another collection point expressly identified on the website;- by cash on delivery when the Buyer or their representative receives the shipment at the chosen destination; or- by bank transfer to the account specified in the payment instructions, or through another electronic payment method offered on the website.
Payment availability depends on technical capabilities and applicable legislation. Any unavailable methods, such as online card payments or card payments at collection, are indicated before the order is submitted.
4.2 Amount payable
The total purchase amount comprises the price of the Goods, VAT at the applicable rate where the Seller is a VAT payer under Act No. 235/2004 Coll., and packing and delivery costs unless agreed otherwise.
Once the contract has been concluded, the agreed amount may be changed only by individual agreement between the parties.
4.3 Payment deadlines
Cash payments and cash-on-delivery payments, including delivery charges, fall due when the Buyer or their representative receives the Goods.
Unless another deadline is agreed, a bank transfer must be paid within ten days after the contract is concluded. The Buyer must include the variable symbol or other payment reference communicated by the Seller. Payment is completed when the funds reach the designated account.
4.4 Failure to pay
If any amount remains unpaid after its due date, the Seller may cancel the order or withdraw from the contract. The Buyer is not entitled to damages resulting from that cancellation or withdrawal.
4.5 Invoicing
The Seller issues an invoice using the information supplied with the order. The document contains the particulars required by Czech legislation, including VAT where the Seller is legally entitled to charge it.
5. Shipping, collection and inspection
5.1 Delivery arrangements
Unless the contract provides otherwise, the Seller determines the shipping method. If the Buyer requests a different arrangement, the additional costs and associated risks are borne by the Buyer.
5.2 Accepting the shipment
The Buyer must accept the Goods at the agreed place and time. Where a shipment is left uncollected or refused without a proper reason, the Seller may claim the delivery costs actually incurred and may withdraw from the contract. Such withdrawal does not give the Buyer a right to damages.
If delivery must be repeated or carried out by another method for technical, organisational or other reasons, the Buyer pays the resulting costs unless expressly agreed otherwise.
5.3 Inspection at handover
The Buyer must inspect the outer packaging and the condition of the shipment promptly after it is presented by the carrier. Acceptance may be refused if the packaging is defective or there are reasonable signs that the shipment has been opened without authorisation.
Signing a handover record, delivery note or equivalent receipt confirms that the shipment was accepted in proper condition and that no defects or damage were identified at handover.
5.4 Supplementary shipping rules
Additional delivery conditions may govern particular aspects of transport. They apply only if made available on the website in advance and expressly accepted by the Buyer before ordering.
6. Withdrawal and returns
6.1 Circumstances excluding withdrawal
The Buyer acknowledges the exceptions to withdrawal under Section 1837 of the Civil Code. The exceptions described in these Terms concern supplies of:
- products customised to the Buyer's instructions or made specifically for them;- products subject to rapid deterioration, wear or obsolescence;- products that cannot be accepted back for hygiene reasons after their original packaging has been opened, including the examples of recordings, software and cosmetics given in the return conditions; and- newspapers, magazines and other periodicals.
6.2 Consumer withdrawal period
Where no exception applies, a Buyer acting as a consumer within the meaning of Section 1810 of the Civil Code may withdraw without giving a reason within fourteen days after receiving the Goods.
The withdrawal notice must reach the Seller's contact email before that period expires. The Buyer may use the model withdrawal form referred to in these Terms or send another clear statement communicating the decision to withdraw.
6.3 Returning the purchase
Withdrawal under the preceding paragraph cancels the contract from its beginning. The Buyer must send the Goods back without undue delay and no later than fourteen days after sending the withdrawal notice.
The returned Goods must be complete, undamaged and in their original condition, with accompanying accessories and documentation. Wherever possible, the original packaging should also be included.
6.4 Reimbursement
Within fourteen days of withdrawal, the Seller refunds the payments received, including the original delivery charge. The refund excludes any extra delivery expense resulting from the Buyer's choice of a method more expensive than the least costly standard delivery offered by the Seller.
The Seller may withhold reimbursement until the returned Goods arrive or the Buyer provides evidence of sending them back.
6.5 Reduced value
The Buyer is responsible for a reduction in value caused by handling beyond what is necessary to establish the Goods' nature, characteristics and functioning. Damage, wear or missing components may therefore give rise to a claim for the corresponding loss of value or damage. The Seller may offset that claim against the amount otherwise due for repayment.
6.6 Withdrawal by the Seller before handover
The Seller may withdraw from the contract at any time before the Buyer receives the Goods. Any purchase price already paid is returned without undue delay, within fourteen days at the latest, by transfer to the account communicated by the Buyer.
6.7 Promotional gifts
A gift supplied with a purchase is provided under a gift agreement conditional on the purchase contract remaining in force. If the Buyer withdraws from the purchase, that gift agreement ceases to have effect and the gift must be returned with the Goods.
7. Product conformity and defects
7.1 Governing provisions
Liability for defective performance is governed by Czech legislation, particularly Sections 1914–1925, 2099–2117 and 2161–2174 of the Civil Code and the relevant provisions of the Consumer Protection Act.
7.2 Condition at receipt
The Seller is responsible for ensuring that, when received, the Goods:
- possess the characteristics agreed between the parties or, in the absence of an agreement, the characteristics described by the Seller or normally expected of such products, taking the advertising into account;- are suitable for the stated purpose or the ordinary use of products of that kind;- match the relevant sample or model where quality or design was agreed on that basis;- correspond to the agreed quantity, measurement or weight; and- meet applicable Czech legal requirements.
7.3 Matters outside that responsibility
The preceding obligations do not cover a defect expressly reflected in a reduced selling price, normal wear arising from use, or the pre-existing wear of used Goods corresponding to their condition at receipt or their nature.
A Buyer cannot claim for a defect they knew about before receipt or caused themselves. The same applies to defects resulting from improper use, disregard of instructions or use for an unintended purpose.
7.4 Defects appearing during the first year
For consumer purchases, a defect that becomes apparent within twelve months after receipt is presumed to have existed at handover unless the Seller proves otherwise.
7.5 Where to make a claim
Claims may be made at the Seller's premises or registered office, or through another channel identified in the Online Store. Where a warranty document names a separate repair provider, the Buyer may request repair from that provider if doing so is more accessible and causes less inconvenience.
7.6 Available remedies
Depending on the defect and the statutory conditions, a justified claim may entitle the Buyer to free repair, replacement with conforming Goods, an appropriate price reduction or withdrawal where the defect prevents proper use.
Repair need not be provided where disproportionate to the defect or the nature of the Goods. Replacement depends on its feasibility and reasonableness. The scope of each remedy is determined by the nature of the defect and applicable legislation.
7.7 Processing claims
Claims are handled without undue delay and within the statutory deadlines. The Complaints Procedure below explains submission, handling and notification of the outcome.
8. Customer accounts
8.1 Registration and functions
The Buyer may register through the Online Store. Once registration is completed and login details activated, the resulting customer account allows the Buyer to manage their details, follow orders and make purchases.
An account is not required where the website supports guest checkout.
8.2 Information supplied by the Buyer
Registration and order details must be accurate, complete and current. The Buyer must update changed information promptly and remains responsible for what they provide. The Seller may rely on those details as correct.
8.3 Credentials and access
Account access requires a unique username and password. The Buyer must protect these credentials, keep them confidential and refrain from giving them or account access to anyone else. The Buyer is responsible for third-party use of the account.
The Seller implements suitable technical and organisational safeguards for account access and personal data, including measures under Article 32 GDPR.
8.4 Restrictions and closure
A breach of the account-access rules may result in access being limited, blocked or terminated. Any account cancellation must be proportionate and consistent with applicable law.
The Seller may close an account for prolonged inactivity, after the period of inactivity set by the Seller, or following repeated or serious breaches of the contract or these Terms. The Buyer may request closure at any time.
8.5 Availability
Continuous access is not guaranteed. Maintenance, updates, repairs and other technical changes may temporarily interrupt or restrict account availability.
8.6 Account data
Personal information held in an account is processed under GDPR and Act No. 110/2019 Coll., on the Processing of Personal Data. The Buyer may exercise the applicable rights of access, correction, erasure and restriction of processing.
9. Personal information, marketing and cookies
9.1 Controller and scope
The Seller is the controller of the Buyer's personal data. Controller contact information is provided through the Online Store's contact information and privacy notice.
Personal data are processed to the extent needed to enter into and perform the contract, deliver orders, manage complaints, keep accounts and comply with legal duties. Processing is subject to Regulation (EU) 2016/679 (GDPR), Act No. 110/2019 Coll. and other applicable data-protection rules.
Personal data include any information relating to an identified or identifiable individual, such as their name, email, address, bank details, order information or other identifying characteristics.
9.2 Purposes and legal grounds
The Seller processes data for concluding and performing purchase contracts, recording and delivering orders, issuing invoices, accounting, communicating about orders and enquiries, handling complaints and meeting obligations to public authorities.
Processing relies, as appropriate, on contractual necessity, a legal obligation, consent where required or the Seller's legitimate interest where that interest does not conflict with the individual's rights.
Marketing messages and newsletters are sent on the basis of the Buyer's separate, voluntary and express consent.
9.3 Individual rights and safeguards
Subject to GDPR conditions, the Buyer may request access, correction, erasure, restriction of processing and portability, object to processing and complain to the supervisory authority. Erasure is subject to any continuing need to process information for the contract or legal compliance.
The Seller maintains technical and organisational measures intended to prevent unlawful or unauthorised processing, accidental disclosure, loss and destruction.
Further information about data categories, purposes, legal grounds, retention periods, recipients and the exercise of rights is set out in the privacy notice available on the website before the contract is concluded.
Where processing requires consent rather than another legal ground, providing the relevant data constitutes consent within the scope and for the purposes described here and in that notice.
9.4 Commercial communications
Consent to receive marketing by email, SMS or another communication channel is optional. It is given by actively selecting the relevant subscription box during registration, checkout or newsletter enrolment and then confirming the verification link under a double opt-in process.
Such consent covers processing for commercial messages and related marketing by the Seller or authorised providers in accordance with the law. It is separate from operational messages needed to perform the contract, such as order acknowledgements, dispatch updates and invoices.
Marketing consent may be withdrawn at any time without charge through the unsubscribe link or by contacting the email address specified in the privacy notice.
9.5 Cookies and similar technologies
Use of the Online Store is subject to the cookie arrangements described in these Terms and the privacy notice. By using the site, the Buyer agrees to storage and use within that stated scope and subject to the applicable consent requirements.
Cookies that are not needed for technical operation, including analytics, advertising and marketing cookies, require express consent. That consent may be withdrawn through the site's cookie controls or browser settings.
A separate website notice explains the categories of cookies, their purposes and the available controls and rights.
10. Website use and ownership
10.1 Title to purchased Goods
Unless otherwise agreed, ownership passes to the Buyer only after the purchase price has been paid in full. Before that payment, title remains with the Seller.
10.2 Protected content
The website's software, databases, graphics, text, photographs and other content are protected by copyright and other applicable rights. The Buyer must not interfere with, reproduce, alter, distribute or otherwise exploit protected material in breach of the law or third-party rights without the express written permission of the Seller or relevant rights holder.
10.3 Proper use of the website
The Buyer must not deploy automated tools, programs or procedures that could harm website operation, availability or security, or interfere with other users' rights. Use of the interface must be consistent with its purpose and these Terms.
The Seller is not responsible for errors or damage caused by third-party interference with the website or by use contrary to its intended purpose or these Terms.
10.4 Codes and changed circumstances
Unless expressly agreed in writing, the Seller has not undertaken to follow a code of conduct within the meaning of Section 1826(1)(e) of the Civil Code or comparable rules.
The Buyer assumes the risk of changed circumstances under Section 1765(2) of the Civil Code, including unforeseen external developments affecting contractual performance, provided they were not caused by the Seller.
11. Notices and correspondence
11.1 Communication channels
Unless the parties agree otherwise, written correspondence may be delivered by email, personally or through postal services.
11.2 Receipt of notices
An email is treated as delivered when it reaches the recipient's server. A postal item is delivered when accepted by the addressee or an authorised recipient. An uncollected postal item is also treated as delivered after the ten-day collection period expires.
11.3 Addresses and contact details
Correspondence to the Seller must be sent to the contact address supplied for that purpose or another address subsequently notified. The Buyer is responsible for ensuring that their own delivery information is complete and correct.
12. Supervision and dispute resolution
Consumer protection is supervised by the Czech Trade Inspection Authority. Personal data matters fall within the remit of the Office for Personal Data Protection, while the competent trade licensing authority supervises compliance with operational and technical business requirements.
A consumer may request out-of-court settlement of a contractual dispute through the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, Czech Republic, identification number 00020869. Information about the procedure is available at https://coi.gov.cz/.
The European Commission's Online Dispute Resolution platform is also identified as a dispute-resolution channel at http://ec.europa.eu/consumers/odr/. The parties may agree on another out-of-court dispute-resolution body.

Pyrotime — Complaints Procedure
1. Purpose and legal basis
This procedure explains how the Buyer may exercise rights relating to defective Goods purchased through the Online Store and how the Seller receives and resolves those claims.
It is based on Czech legislation, particularly the Civil Code, Act No. 89/2012 Coll., Section 1914 et seq.; the Consumer Protection Act, No. 634/1992 Coll.; GDPR where personal data are involved; and other relevant product-safety and electronic-commerce requirements.
2. Claim periods
Rights relating to defective performance may be exercised within twenty-four months of receiving the Goods. Time spent undergoing repair by the Seller extends that period.
Unless otherwise agreed, the period starts on delivery to the Buyer. A defect must be reported without undue delay after discovery.
For business customers, time limits may be adjusted by agreement and the applicable Civil Code provisions, including the reference to Section 2161.
3. Submitting a complaint
A claim may be submitted electronically to the Seller's contact email or in writing, personally or by post, at the address designated for complaints in the Online Store.
The submission must identify the Buyer by name and address and, for business customers, company and VAT identification numbers where applicable. It must also state the order number, the date the Goods were received, the defect being claimed and the circumstances in which it was discovered.
The Buyer is responsible for the accuracy and completeness of that information and bears the consequences of delays caused by incorrect addressing or delivery details.
4. Preparing the Goods and supporting information
When making a claim, the Buyer must provide proof of purchase, such as an invoice, tax document or warranty certificate; submit the Goods with their accessories and packaging; and give a detailed description of the problem, including photographs where relevant.
The Goods must be handled safely and in accordance with the manufacturer's instructions. Before shipping a pyrotechnic product, the Buyer is advised to contact the Seller to arrange a safe transport method. Packaging must protect the Goods against additional damage in transit.
When accepting a shipment from a carrier, the Buyer must check the packaging. If it is damaged, a damage record must be prepared and the Seller informed.
5. Acknowledging the claim
The Seller provides written acknowledgement identifying the product, the date the complaint was received, the reported defect and the remedy requested by the Buyer.
This acknowledgement is supplied electronically or in another agreed form.
6. Handling and outcome
The Seller decides on and handles the complaint without undue delay, within thirty calendar days of receipt at the latest.
The Buyer receives written information explaining the outcome, the remedy provided and any repairs undertaken. For complex claims, the Seller informs the Buyer about progress and the anticipated completion date.
If the processing period has not been extended and the Seller fails to resolve the complaint in time, the Buyer may request replacement or withdraw from the purchase contract.
7. Particular rules for pyrotechnic products
Complaints concern unused pyrotechnic products only.
For a product that has failed to function, a claim may be made only on the basis of photographic evidence taken from a safe distance. That evidence must show the malfunction and the state of the ignition component, including a burnt fuse, and identify both the product and the date the photographs were taken.
The Buyer must follow the use and disposal instructions on the packaging. Using pyrotechnics contrary to those instructions or the law is prohibited and excludes the right to make a complaint.
8. Grounds for rejection
A claim ceases to be available where the problem results from normal wear, improper handling, excessive loading, natural events such as water or fire, or use contrary to the manufacturer's instructions.
Any rejection must be explained by the Seller in writing.
9. Costs
For a justified complaint, the Buyer is entitled to reimbursement of necessary expenses incurred in pursuing it, particularly transport costs. No reimbursement is due for an unjustified claim.
10. Records
Complaint reports and supporting documentation are retained electronically in accordance with the Accounting Act. The Buyer may access records relating to their own complaint.
11. Personal data connected with complaints
Information supplied during the complaints process is processed solely for handling the complaint and in accordance with GDPR.
The Buyer may request access to their information, correction of inaccurate details and erasure where the data are no longer needed to perform the contract, and may object to processing.
